Article 1 — Purpose and scope

These general terms and conditions of sale govern sales concluded on animauxdirect.com between AFC FORMATION, a sole trader registered under SIRET 532 384 716 00017, with its registered office at 10 Rue Paul Lafargue, 91550 Paray-Vieille-Poste, France ("the Seller") and any non-professional consumer ("the Customer").

They apply to sales to Metropolitan France only. Placing an order implies unreserved acceptance of these terms, which the Customer accepts by ticking the box provided before validating the order.

Article 2 — Products

The products offered are accessories, toys, grooming items and supplements for pets. The essential characteristics of each product appear on its product page. Photographs are illustrative and may differ slightly from the item delivered.

Article 3 — Prices

Prices are shown in euros, inclusive of all taxes, excluding delivery costs which are shown separately before the order is validated. The total amount due appears on the summary page before payment. No customs fees or import duties will be charged to the Customer.

The Seller may change prices at any time; products are invoiced at the rate in force when the order is validated.

Any price reduction announcement states the lowest price applied during the 30 days preceding the reduction, in accordance with article L112-1-1 of the French Consumer Code.

Article 4 — Placing an order

The Customer selects products, checks the basket, enters their details, reads and accepts these terms, then validates the order. Validation is made using a button bearing the wording "Commander avec obligation de paiement" (order with obligation to pay), in accordance with article L221-14 of the French Consumer Code.

A confirmation email summarising the order is sent to the Customer. The sale is complete only once payment is confirmed.

The Seller may refuse an order in the event of a previous dispute, an abnormal order, or suspected fraud.

Article 5 — Payment

Payment is made online by bank card, PayPal, Apple Pay, Shop Pay or Klarna. Transactions are secured by our payment providers. The Seller stores no bank details.

Article 6 — Delivery

Area: Metropolitan France only.

Preparation time: 1 to 2 business days.
Transit time: 5 to 8 business days.
Total time: 6 to 10 business days.

In accordance with article L216-1 of the French Consumer Code, the Seller undertakes to deliver no later than 30 days after the contract is concluded. If this is exceeded, the Customer may, after formal notice has gone unanswered, terminate the contract and be reimbursed within 14 days.

Delivery costs: €4.99 for orders under €50, free from €50.

In accordance with article L216-4 of the French Consumer Code, the risk of loss or damage passes to the Customer when they take physical possession of the goods.

Article 7 — Right of withdrawal

The Customer has 14 calendar days from receipt of the goods to exercise their right of withdrawal, without reason or penalty (article L221-18). Full details and the standard form appear on our Withdrawal Form and Returns and Refunds pages, which form an integral part of these terms.

Reimbursement is made within 14 days of notification of withdrawal, using the same payment method.

Article 8 — Legal guarantees

The Customer benefits from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code), lasting 2 years from delivery, and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

These guarantees apply independently of any commercial warranty and cannot be excluded.

Article 9 — After-sales service and complaints

Complaints should be sent to animauxdirect@gmail.com. The Seller undertakes to reply within 48 business hours and to resolve the complaint within a maximum of 60 days.

Article 10 — Consumer mediation

Under article L612-1 of the French Consumer Code, where a dispute remains unresolved after a written complaint to the Seller, the Customer has the right to refer the matter free of charge to an approved consumer mediator. See our Legal Notice.

Article 11 — Personal data

The data collected is necessary to process orders. The data controller is AFC FORMATION. The Customer has rights of access, rectification, erasure, restriction, objection and portability, exercisable at animauxdirect@gmail.com, together with the right to lodge a complaint with the CNIL. See our Privacy Policy.

Article 12 — Governing law and jurisdiction

These terms are governed by French law. In the event of a dispute, and failing amicable resolution or mediation, the French courts have jurisdiction in accordance with the rules applicable to consumers.

Article 13 — Amendment

The Seller may amend these terms at any time. The terms applicable to an order are those in force and accepted by the Customer on the date of that order.
